OVERVIEW

Welcome to Ame Jelly! This website is operated by Ame Jelly, ABN 59 598 302 120 ("we", "us", "our"). Throughout this site, these Terms apply to all users — including browsers, customers, and anyone placing an order.

By visiting our site and/or placing an order with us, you agree to be bound by the following Terms of Service ("Terms"), including any additional terms, conditions and policies referenced here or linked on our site — including our separate Refund, Replacement and Cancellation Policy.

Please read these Terms carefully before using the site. If you don't agree with any part of them, please don't use the site or place an order.

We may update these Terms at any time by posting changes to this page. It's your responsibility to check back periodically. Continuing to use the site after changes are posted means you accept the updated Terms.

SECTION 1 — WHO WE ARE

Ame Jelly is based in New South Wales, Australia. You can reach us anytime amejelly@gmail.com.

SECTION 2 — USING OUR SITE

By using our site or placing an order, you confirm that:

  • you're at least 18 years old, or using the site with a parent or guardian's consent and supervision;

  • you'll only use the site for lawful purposes and won't breach any applicable law (including copyright law) while doing so;

  • you won't transmit viruses, malicious code, or anything designed to disrupt the site; and

  • any information you give us (name, delivery address, contact details) is true, current and complete, and you'll keep it up to date.

We may refuse service, cancel orders, or restrict access to the site at our discretion: for example, where we suspect fraud, misuse, or a breach of these Terms.

SECTION 3 — OUR PRODUCTS

We sell handmade and fan-inspired goods including keychains, deskmats, stickers and gacha charms, along with other items listed on the site from time to time.

We do our best to display colours, sizes and details accurately, but slight variations can happen, for example due to screen display differences or natural variation in handmade items. Prices, descriptions and availability may change at any time without notice, and we may correct genuine listing or pricing errors before confirming your order.

We reserve the right to limit quantities, refuse an order, or discontinue a product at our discretion. Products are subject to return, replacement or refund only in accordance with our Refund, Replacement and Cancellation Policy.

SECTION 4 — ORDERS AND PAYMENT

Placing an order is an offer to buy, which we accept once we confirm your order (usually by email). We may decline or cancel an order at any time, for instance, if an item is out of stock, there's a pricing error, or we suspect fraudulent activity, in which case we'll let you know and refund any payment already made.

All prices are listed in Australian dollars (AUD) and include GST where applicable. Payment is required in full at checkout.

Payments are processed securely through Stripe. We never see or store your full card details, these are handled directly by Stripe under Stripe's own terms and privacy policy.

SECTION 5 — SHIPPING, DELIVERY AND TRACKING

We currently ship to Australia, the United States, and countries across Asia. If you're not sure whether we ship to your country, email us at amejelly@gmail.com and we'll let you know.

Every order can be sent with tracking (extra shipping fees apply) or without tracking, and we'll send you your tracking details once your order is on its way. All orders over $100 receive free tracking shipping from us.

As a general guide only:

  • Within Australia: typically around 2–6 business days once shipped, depending on your location.

  • To the US and across Asia: typically around 5–10 business days once shipped, depending on your destination and local customs processing.

These timeframes are estimates, not guarantees, actual delivery can vary due to customs clearance, peak periods, or other factors outside our control. Once your order has been handed to the carrier, it's subject to the carrier's own delivery process.

SECTION 6 — CANCELLATIONS

You can cancel your order for a full refund any time before it has shipped, just email us at amejelly@gmail.com with your order number.

Once an order has shipped, it can't be cancelled. From that point, a refund or replacement is only available where the item is faulty, doesn't match its description, or doesn't work as intended — see our Refund, Replacement and Cancellation Policy for details. We don't offer cancellations or refunds after shipping for a change of mind.

SECTION 7 — CONSUMER GUARANTEES

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You're entitled to a replacement or refund for a minor or major failure, and to have an item repaired or replaced if it fails to be of acceptable quality.

Full details on how this works in practice — including what's covered, what's not, and how to request a remedy — are set out in our separate Refund, Replacement and Cancellation Policy. Nothing in these Terms limits your rights under the ACL.

SECTION 8 — INTELLECTUAL PROPERTY

Everything on this site, including but not limited to, product photos, artwork, designs, logos and text rightfully belongs to Ame Jelly or is used under licence, and is protected by copyright and other intellectual property laws. You're welcome to view and download content for your own personal, non-commercial use, but reproducing, reselling or using it commercially without our written permission is strictly prohibited.

Where our products reference or are inspired by third-party franchises, characters or brands, those trademarks and copyrights remain the property of their respective owners. Unless stated otherwise, our products are fan-made/inspired works and not officially licensed merchandise.

SECTION 9 — PROHIBITED USES

You agree not to use our site:

  • for any unlawful purpose, or to encourage unlawful acts;

  • to breach any applicable law or regulation;

  • to infringe our intellectual property rights or anyone else's;

  • to harass, abuse or discriminate against anyone;

  • to submit false or misleading information;

  • to upload viruses or malicious code; or

  • to interfere with, scrape, or circumvent the security of the site.

We may suspend or end your access to the site if you breach any of these.

SECTION 10 — THIRD-PARTY LINKS AND TOOLS

Our site may link to, or use tools from, third parties, including Stripe for payments and shipping carriers for delivery. We don't control these third parties and aren't responsible for their content, terms or practices. Any use of a third-party site or tool is at your own risk and subject to that third party's own terms & conditions.

SECTION 11 — ACCURACY OF INFORMATION

We try to keep information on the site accurate and current, but errors, omissions or delays can happen, including around pricing, product descriptions or delivery estimates. We reserve the right to correct these at any time, including after you've placed an order, and will let you know if it affects your order.

SECTION 12 — LIABILITY

To the maximum extent the law allows, and always subject to your rights under the ACL:

  • our liability for any issue with our products is limited to, at our choice, repairing, replacing, or refunding the item; and

  • we're not liable for indirect or consequential loss (such as loss of profits or data) arising from your use of the site or our products.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that can't lawfully be excluded under the ACL.

SECTION 13 — INDEMNITY

You agree to indemnify us against any claim, loss or cost (including reasonable legal fees) arising from your breach of these Terms or misuse of the site.

SECTION 14 — PRIVACY

We collect personal information, like your name, delivery address, email and order details — only to process and deliver your order, and to communicate with you about it. Payment details are handled directly by Stripe and never stored by us. We don't sell or share your personal information with third parties beyond what's needed to fulfil your order (e.g. our shipping carriers and Stripe).

SECTION 15 — SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, that part will be removed and the rest will continue to apply.

SECTION 16 — GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia, and you and Ame Jelly submit to the non-exclusive jurisdiction of the courts of New South Wales.

If a dispute arises, please contact us first at amejelly@gmail.com so we can try to remedy the issue. You can also contact NSW Fair Trading (13 32 20, fairtrading.nsw.gov.au) or the ACCC (1300 302 502, accc.gov.au) for more information about your rights.
